Terms & Conditions

These conditions are an agreement between all parties. Any infringement permits the Agent/Owner to refuse the guest to occupy the property, amend the rental and/or terminate the booking/occupancy without refund. Variances can be agreed on but only by arrangement with the owner in writing.

Properties are available to review directly via our website www.phillipisland.com.au.
Upon booking, the guest hereby accepts the premises as acceptable.

Booking Fee
A booking fee (GST Inclusive) applies to all holiday accommodation properties managed by OBrien Judith Wright. This booking fee is NON-refundable and additional to the rental accommodation charge and has been included in your booking total.

OBrien Judith Wright acts as booking agent’s for property owners. The agency will not be held responsible for actions taken by the owner of the premises or other occurrences that are outside of our control such as:
– The property is withdrawn from letting
– Owner declines booking
– Damage to premise and/or emergency situations

Should any of the above occur every reasonable endeavour will be made to find alternative accommodation.

Payment
Payments are made via an encrypted third-party service. By utlising this service you are acknowledging acceptance to the terms and conditions provided.
A 50% deposit and applicable booking fees are required to secure your booking. Payment of the rental deposit constitutes the client’s acceptance of these Terms & Conditions. The balance of the total booking is required 30 days prior to occupancy. If booking within 30 days of arrival full payment will be required at the time of booking. A surcharge will apply to all credit card payments based on the relevant banks policy. (Visa and Mastercard are accepted).

Security Deposit (Bond)
All bookings require a security deposit to be paid prior to collecting keys.
Contact will be made 7 days prior to your arrival to request payment.
Payments are made via an encrypted third-party service. By utlising this service you are acknowledging acceptance to the terms and conditions provided.

Check-in Details
Keys will not be made available until all booking costs and the security deposit have been paid.
Arrangements for the collection of keys outside of office hours should be made prior to arrival. Keys must be returned to same location as they were originally collected – failure to comply will incur a key collection fee of $50 which will be deducted from your security deposit.

Cancellation
Cancellations made at least 60 days prior to the original arrival date will receive a full refund, after 60 days, bookings are not refundable unless the property is re-let for the entire period. The booking fee is non-refundable and a $50 cancellation fee will apply to all cancelled bookings at all times. Under no circumstances will refunds apply for early departure or refusal to stay at a booked property.

Arrival and Departure Times
Key collection is available between 2:00pm-5:00pm 7 days per week. Key collection information is provided within 24 hours of your stay.

Departures must take place prior to 10.00am. Additional charges may apply if you fail to check-out on time.

It is the guest’s responsibility to advise our agency (during business hours) should they require after-hours key collection. Our agency will not be responsible for alternate accommodation or any other costs incurred by guests arriving after hours if no prior arrangement has been made and confirmation received by the guest.

Linen
Properties have varying linen options, please refer to your specific property description to confirm whether linen is supplied.  Our agency will not be held liable for linen costs.

Damage to property
It is a requirement of all guests to report any damage to the premises immediately.

No Smoking
Please note smoking is not permitted indoors. Outdoor smoking is acceptable, guest are required to remove all evidence of smoking upon departure. Failure to comply will result in cleaning costs being incurred.

Pets
Properties have varying pet permissions. Please refer to your specific property description to confirm whether pets are approved and whether there are indoor or outdoor restrictions. All evidence of pets must be removed upon departure. Damage to properties must be reported and rectified. Failure to comply will result in additional costs being incurred.

Guests opting to take pets to non-pet approved properties risk eviction and loss of booking payment or bond deduction.

Cleaning
Upon departure guests are required to return the property to original condition. Failure to comply will result in additional costs being incurred.

Accommodating extra persons (exceeding the property’s advertised capacity)
Camping or accommodating extra guests is prohibited. This is a requirement of the Bass Coast Council and fines will apply.

Parties and functions are strictly prohibited. Failure to comply will result in additional costs being incurred.

Concerns regarding your stay

Indemnity
You, the Guest, indemnify the agency against any liability which may attach to the agency as a result of damage, injury, loss or inconvenience being personal or proprietary suffered by any person where damage, injury or loss has been contributed to or caused by any act or occasion of the tenant or his visitor. These conditions are an agreement between the parties. Any infringement of the above conditions permits the agency to refuse a key, amend the rental or immediately terminate the booked stay.

Vacate Demand
The Guest must vacate the premises upon demand of the Agent or Owner without refund upon breach of this agreement. Infringements include incorrect information supplied to the agency upon booking the property, causing malicious damage to the property being/causing a public nuisance, excess noise, accommodating more persons than agreed, parties or setting up makeshift structures or ignoring warnings or requests from the agent.

Inspections
The Agent or Landlord can make an inspection of the premises upon demand.

Council Regulations
Must be complied with at all times. Click here to view.
All properties are located in residential areas, guests are considerate regarding noise as per the council regulations.
Failure to comply with council regulations will result in additional costs being incurred.

Lost & Forgotten Items
Our agency accepts no responsibility for items left at properties. Items reported as lost that are located by our team will be returned at the guest’s expense. Items not reported to our agency will be held for 7 days and then disposed of.
